This website is operated by Emine Salih, trading as August is forever. Throughout the site, the terms “we”, “us” and “our” refer to August is forever.

By visiting our website and/or purchasing something from us, you agree to be bound by these Terms of Service, together with any additional terms, policies and notices referenced on this website.

Please read these Terms of Service carefully before accessing or using our website. By accessing any part of the site or placing an order with us, you agree to these terms.

Nothing in these Terms of Service affects your statutory rights under UK consumer law.

By using this website, you confirm that you are legally capable of entering into a binding contract.

You may not use our products or website for any unlawful or unauthorised purpose, nor may you violate any applicable laws in your jurisdiction through your use of our website.

We reserve the right to refuse service, cancel an order or restrict access to the website where we reasonably believe there has been fraudulent, abusive or unlawful activity.

3. PRODUCTS

We make every reasonable effort to display our products, colours and finishes as accurately as possible. However, the appearance of colours may vary depending on your screen or device.

Many August is forever garments are individually hand-dyed and finished. Because of the nature of this process, variations in colour, pattern, placement and finish are expected.

These variations are part of the individual character of the garment and mean that no two pieces will necessarily be identical.

Where appropriate, product descriptions will identify products that have been individually dyed or finished.

Nothing in this section affects your statutory rights if a product is faulty, damaged, not as described or otherwise does not conform to your legal rights.

4. PRODUCT AVAILABILITY

All products are subject to availability.

We produce in limited quantities and cannot guarantee that an item or size will remain available.

Adding an item to your basket does not reserve that item. Your order is not confirmed until checkout has been completed and you have received an order confirmation from us.

In the unlikely event that an item becomes unavailable after you have placed an order, we will contact you and issue an appropriate refund.

5. PRICES AND PAYMENT

All prices displayed on our website are shown in GBP (£) unless otherwise stated.

The price payable is the price displayed at the time your order is placed.

We reserve the right to change our prices at any time, but changes will not affect orders that have already been accepted.

Payment must be made using one of the payment methods available at checkout.

If an obvious pricing or product information error occurs, we reserve the right to correct the error. If this affects an order you have already placed, we will contact you before proceeding where required.

6. ORDERS

Once you place an order, you should receive an order confirmation by email.

An order confirmation acknowledges that we have received your order. We reserve the right to decline or cancel an order where reasonably necessary, including in cases of suspected fraud, payment problems, stock errors or an obvious pricing error.

If we cancel an order after payment has been taken, you will receive a refund for the amount paid for the cancelled item or order.

Please check the information you provide at checkout carefully. You are responsible for providing a complete and accurate delivery address.

If you notice an error after ordering, contact us as soon as possible at customerservice@augustisforever.com. We cannot guarantee that an address can be changed once an order has been dispatched.

7. SHIPPING AND DELIVERY

We currently ship to addresses within the United Kingdom.

Our current UK delivery service and estimated delivery timeframe are displayed at checkout and/or within our Shipping Policy.

Delivery estimates are estimates rather than guaranteed delivery dates unless expressly stated otherwise.

We are not responsible for delays outside our reasonable control. Where a significant delay occurs, we will provide any remedies required under applicable consumer law.

8. RETURNS, CANCELLATIONS AND REFUNDS

Your rights to cancel an online order and return eligible products are set out in our Return and Refund Policy.

For eligible UK online purchases, customers generally have a statutory right to cancel within 14 days of receiving their goods, subject to applicable exceptions.

Returned products must be handled only to the extent reasonably necessary to establish their nature, characteristics and functioning. We may make a deduction from a refund where the value of goods has been diminished as a result of handling beyond what would reasonably be permitted in a shop, where allowed by law.

Nothing in our returns policy or these Terms limits your statutory rights in relation to products that are faulty, damaged, not as described or otherwise do not conform to applicable consumer law.

9. PRODUCT CARE

Some August is forever garments use specialist dyeing and printing techniques and should be cared for appropriately.

Unless otherwise stated on the product or accompanying care information, we recommend:

Wash at 30°C, inside out and with similar colours. Do not bleach. Do not tumble dry. Reshape while damp and air dry. Iron inside out on a low heat. Do not iron directly over printed artwork.

Customers should follow the care instructions supplied with their garment.

This does not affect your statutory rights in relation to a product that is faulty or does not conform to contract.

10. INTELLECTUAL PROPERTY

The AUGUST is forever name, trademark, logo, branding, designs and associated creative materials are the intellectual property of August is forever.

All content on this website, including but not limited to our branding, graphics, garment designs, artwork, photography, written content and other creative material, is owned by August is forever or used by us with permission and is protected by applicable intellectual property laws.

You may access and use this website for your own personal, non-commercial purposes only.

You must not copy, reproduce, modify, distribute, publish, sell, commercially exploit or otherwise use our trademark, branding, designs, imagery, artwork or other protected material without our prior written permission, except where permitted by law.

Nothing on this website grants any licence or right to use the AUGUST is forever name, trademark, branding or other intellectual property without our prior written consent.

We reserve all rights in our intellectual property and may take appropriate action where those rights are infringed.

We are not responsible for the content, availability or practices of third-party websites that we do not control.
